Netflix has actually been prosecuted by Texas’ Tyler County grand jury over the movie Cuties
According to the court documents acquired by E! News, the streaming service is dealing with a charge of “promo of lewd visual material depicting kid.”
The documents state Netflix is being accused of promoting “visual product which depicts the lewd exhibit of the genitals or pubic area of a clothed or partially clothed child who was more youthful than 18 years of age at the time the visual material was produced, which appeals to the prurient interest in sex and has no serious literary, artistic, political or clinical worth.”
Netflix responded to the allegations in a statement to E!
The indictment appeared to be submitted Sept. 23.
” As a district lawyer, I have to sift through many cases and make calls every day on how to keep our neighborhoods safe,” Babin mentioned in the release. “In our county, it is not unusual for me to confront cases with underage victims.”
He then noted that, “after finding out about the movie Cuties and seeing it,” he “understood there was possible cause to believe it was criminal” under the Texas Penal Code.
” The lawmakers of this state think promoting certain lewd material of kids has harmful consequences,” he continued. “If such product is distributed on a grand scale, isn’t the requirement to prosecute more, not less? A grand jury in Tyler county found probable cause for this felony, and my job is to promote the laws of this State and see that justice is done.”
According to Netflix’s site, Cuties— which is rated TV-MA– is about an 11- year-old named Amy, who “begins to rebel against her conservative family’s customs when she ends up being interested with a free-spirited dance crew.”
Netflix later released an apology.
” We’re deeply sorry for the unsuitable artwork that we used for Mignonnes/Cuties,” it stated at the time. “It was not OKAY, nor was it agent of this French movie which won an award at Sundance. We’ve now updated the photos and description.”
Author and director Maïmouna Doucouré has likewise stood by the movie.
